[問題] H4/AP/EAD 出境問題

大家好 最近綠卡走到即將要送485階段 我是H1B 老婆H4 想在送485時幫老婆申請EAD讓她工作 但我們農曆年想回台灣 今天律師跟我說 Please note that you must be in the U.S. when we file your green card applicat ions and you must remain in the U.S. until the EAD/AP cards are approved. If you travel on your H-1B or H-4 visa while the AP application is pending, this application will be denied. It isn't that critical for you but if your wife w ould like to work, then she will also need the AP to travel. 你老婆如果用了EAD工作,會失去H4身份,就只能用AP入境

只有排期的人可以申請H4 EAD;目前只有中國人及印度人可以
