以下是個人在別處的舊文 (2003):
其實美國法院曾在 1893 年就進口商申報蕃茄是水果免稅,
而海關認為是蔬菜應該課稅而做出判決.

Botanically speaking, tomatoes are the fruit of a vine, just as are
cucumbers, squashes, beans, and peas. But in the common language of
the people, whether sellers or consumers of provisions, all these
are vegetables which are grown in kitchen gardens, and which, whether
eaten cooked or raw, are, like potatoes, carrots, parsnips, turnips,
beets, cauliflower, cabbage, celery, and lettuce, usually served at
dinner in, with, or after the soup, fish, or meats which constitute
the principal part of the repast, and not, like fruits generally,
as dessert.
重點是最後一句. 因此, 法院判決, 蕃茄是蔬菜.
日本農林水產省依植物學定義: 一年生的草本植物是蔬菜, 而多年生木本植物的果實
就是水果. 若依此定義, 蕃茄(茄科, 一年生草本)算是蔬菜.而香瓜(一年生草本),
草莓(多年生草本), 西瓜(一年生草本) 都該歸類為蔬菜.
後來又給了這些為 "果實的野菜"(水果蔬菜) 的名稱.
