各位好先說明一下背景在下是在台灣拿的BA 然後到San Diego拿了相同科系的MA 本來是打算回台灣不過正好有個朋友工作的地方在招募員工而運氣很好的是他是公司的Administrator 也就是人資的部分由他掌握大權.. 所以在我對他說明了我本來想回台灣若無法申請H1B便失去留在美國的意義後他一口答應幫我申請H1B 可是這公司是個小公司人資由他掌大權換個角度來說就是所有困難的事都是他一個人弄而這部分他也沒經驗所以自然而然他希望我把該找的資訊找好他只負責簽名跟大致瀏覽避免錯誤發生首先我們面對的是公司沒僱過外國人所以要在US department of labor的網站上填 ETA form 9035. 這個表格的內容是關於僱主對我的職稱薪水等等的基本資料可是我們submit了之後被denied 而他的解釋是我們沒有把Prevailing Wage的區塊填好看了他的回應信件我們還是不太懂該怎麼做這邊附上他們的回應 1. Section F.1 of this application contains an obvious inaccuracy. According to the General Instructions for ETA Form 9035 & 9035E, "The employer must enter whether the rate of pay is per hour, per week, bi-weekly, per month, or per year. 很怪的是我們明明就填了$15 也勾了per hour 但他卻還是嫌我們沒填好... 不是很懂冏然後是這一段有關Prevailing Wage 2. In combination, Sections G.7, G.7a, and G.11b of this application contain an obvious inaccuracy or are incomplete. According to ETA Form 9035 CP - General Instructions for the 9035 & 9035E: Section G.7: If the employer received a Prevailing Wage Determination (PWD) from the National Prevailing Wage Center (NPWC), enter the name of that issuing Agency in Section G.7. Use this field ONLY where the employer obtained a prevailing wage from the NPWC. Section G.7a: Enter the prevailing wage tracking number assigned by the NPWC. Use this field ONLY where the employer obtained a prevailing wage from the NPWC. A valid prevailing wage tracking number, as assigned by the National Prevailing Wage Center (NPWC), contains "P" followed by 14 digits (e.g. P-###-#####-######) and relates to a NPWC-issued prevailing wage determination. Section G.11b: This field should be used in circumstances where the employer has marked "Other" in section G.11, OR has marked "OES" in section G.11 and the employer did not obtain a prevailing wage from the NPWC. For example, if the employer obtained a prevailing wage using OES data from the Foreign Labor Certification Data Center Online Wage Library at http://www.flcdatacenter.com , then the words 'OFLC Online Data Center' must be entered in the space provided. The employer's entry in G.11b does not follow these instructions. 我們找到的Prevailing wage來自上面那個網址而非NPWC 是不是就應該略過G7的兩個空格? 然後是不是只要再G11勾選OES 並在G11b裡寫Foreign Labor Certification Data Center Online Wage Library 就可以了? 還有...就是在這個申請系統裡不能修改已submit的申請我們是不是必須要重開一個表格? 而若是只有這兩大項問題我們修改後再次submit 若是被接受下一步我們該怎麼做呢@@? 麻煩有經驗的板友幫忙回覆一下非常感謝如果有需要圖片檔案或是其他資訊請提出我會盡快回應先感謝各位幫助了~ -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 99.113.194.78
