[問題] 職業移民的排期保留 (PD Retention)

最近一個印度朋友遇到的問題想請教各位大大，我朋友他是 EB2，要排很多年，最近經濟的影響，公司也不知道能撐多久，他最近 PERM 下來，本來想丟I-140 （因為他有聽聞如果他去其它公司， PD 可以跟著他)，後來公司跟他說不行，只有 I-485 pending 180天的人的人可以。我跟他說律師應該是指 AC21，律師也許誤會他的意思、或著是不想跟他說。台灣人大部分應該都不會有這方面的問題，我在版上沒有找到類似的問題，我找到8 CFR 204.5 ，上面有一段: 「(e) Retention of section 203(b) (1), (2), or (3) priority date. A petition approved on behalf of an alien under sections 203(b) (1), (2), or (3) of the Act accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b) (1), (2), or (3) of the Act for which the alien may qualify. In the event that the alien is the beneficiary of multiple petitions under sections 203(b) (1), (2), or (3) of the Act, the alien shall be entitled to the earliest priority date. A petition revoked under sections 204(e) or 205 of the Act will not confer a priority date, nor will any priority date be established as a result of a denied petition. A priority date is not transferable to another alien. 」上面看起來似乎是說，只要之前的 I-140 已經核准(並且沒有取消)，之後的I-140就可以使用之前的Priority Date。上述也沒有提到需要類似的工作，只講要符合 203(b)(1),(2),or(3)。請問這樣解釋正確嗎？如果他離開現在的公司，如果公司不撤銷他的 I-140，是不是就沒問題了？公司要是日後倒掉，之前的I-140還有效嗎？請大大指點，謝謝！ -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 174.48.126.243
