[問題] F1 依親綠卡與 CSPA 問題

最近在協助朋友的家人辦綠卡，他們家庭成員如下
父、母：均沒有美國籍
朋 友：長女，是美國公民，目前在美國就學中
弟、妹：均沒有美國籍，均未婚且未滿 21 歲（分別於1995、1997年出生）
這次的移民申請由朋友提出，希望以 FB1讓母親一人取得綠卡，同時附帶 CSPA
的方式讓弟妹兩人也隨母親一同取得綠卡，而不會被判為 FB4類別。
結果朋友今天接到 NVC來信，通知 I-130的審核結果是只有母親取得 FB1類別，
弟妹兩人均被判為 FB4，請問這種情況是正常的嗎？如果不是，該如何向 NVC申
請改判類別？

STEP ONE: Does the CSPA apply to the case?
Was the derivative applicant under 21 years of age when petition
was filed?
Yes.兩位附屬申請人一人 20 歲，一人 18 歲。
STEP TWO: If the CSPA applies in Step 1, calculate the alien's age
with the following data:
(A) the date a visa number became available for the applicant's use,
FB1的排期是 current
(B) the applicant's date of birth,
(C) the date the visa petition was approved by the U.S. Citizenship
and Immigration Services, and
今天 I-130通過，所以是2015年 2月12日
(D) the date the visa petition was filed or the priority date.
2014 年 7 月14日
由於 I-130審核時間只有六個月，所以年齡都只能夠扣掉這六個月而已，應該不
至於影響結果。
