Since it's been done, you cant do anything about it. Let me share my view so you can sleep better every night until you get your GC. I assume your 1099 earnings is relatively or very small, and small enough no tax at all or little. But I doubt it's high cuz otherwise the church would be your emloyer. Is there any risk? YES, but very tiny. 1. Your attorney said you will be fine. I agree. 2. 1099 misc is for misc and non-employee 3. You or ur employer only have to submit ur W2 not 1040 for I140 right? 4. 2 of my friends had the similiar situations; they got GCs 5. In fact, I have 1099s from time to time. Both 1099 DIV & 1099 INT. Never had a problem. Besides, going to church is a good reason to rebuttle. You go to church to serve God, and the church is generous to give you some patty cash. Then you feel irresponsible not to report to IRS. Because of that, you cant get your GC? Not to mention ONLY IF USCIS would come to knock on your door, but I highly doubt they would. They dont ahve time for this. They intend to watch closely on sensitive industries or fraudulent activites like small fake compaies for employment-based, family-based or marriage-based. IRS & USCIS are tough but not evil.
